Public Notice of Intent to Award Sole-Source Contract

Splash Pad System – Compatible Replacement Parts and Components

Date of Notice: January 15, 2026

Pursuant to ORS 279B.075 and the public contracting rules of the Wiard Memorial Park District (“District”), the District hereby gives public notice of its intent to enter into a sole-source contract for splash pad system parts and components.

Proposed Contractor: Vortex (original manufacturer and direct seller)

Description of Goods / Services: The District intends to purchase manufacturer-approved and compatible replacement parts, components, and accessories for the District’s existing splash pad water play system located at Wiard Memorial Park. The existing system was designed and installed by Vortex, and the District’s preliminary determination is that compatible, manufacturer-approved parts and components are available only from Vortex as the original manufacturer and direct seller.

Basis for Sole-Source Procurement:

District staff have prepared a Written Determination of Sole-Source Procurement concluding that:

1. The District’s existing splash pad system is a proprietary design and product line of Vortex;

2. Compatible replacement parts, components, and accessories must be manufacturer-approved to maintain system safety, performance, and warranty coverage; and

3. No other vendors or distributors have been identified who are authorized to provide manufacturer-approved, compatible replacement parts and components for the District’s existing splash pad system.

A copy of the written determination is available for public inspection at the District office at 2800 Wiard St, Klamath Falls, OR 97603 during regular business hours and, if applicable, on the District’s website at https://www.wiardpark.com.

Opportunity to Protest or Demonstrate Alternative Sources:

Any person or firm who believes they can provide manufacturer-approved and compatible replacement parts and components for the District’s existing splash pad system may submit a written protest of this sole-source determination.

 

Written protests must:

1. Be received by the District no later than 5 p.m. on February 6, 2026.

2. Be clearly marked: "Sole-Source Protest – Splash Pad Parts";

3. Identify the name and contact information of the protestor;

4. Provide a detailed statement describing the basis for the protest, including evidence that the protestor is an authorized source of compatible parts and components for the specific splash pad system owned by the District or that compatible, manufacturer-approved parts and components are available from one or more alternative sources; and

5. Include any relevant technical documentation or manufacturer authorizations supporting the protest.

Board Consideration:

If one or more timely written protests are received, they will be reviewed in accordance with the District’s public contracting rules. The Wiard Memorial Park District Board of Directors, acting as the Local Contract Review Board, will consider the written determination and any protests at a public meeting scheduled for:

Location: Wiard Memorial Park Office/Maintenance Facility, 2800 Wiard Street

After considering the written determination and any timely protests, the Board may: (a) affirm the sole-source determination and authorize the contract; (b) modify the determination or procurement approach; or (c) direct staff to conduct a competitive procurement if it finds the sole-source determination is not supported.

If no timely written protests are received, the District intends to proceed with a sole-source contract with Vortex as described in this notice, subject to final Board approval.
